1. Definitions
For the purposes of these general conditions of sale on the medicalistore.it website, and in addition to the other definitions contained therein, the following terms shall have the meaning set out below.
“General Conditions”: are all the conditions of sale on the medicalistore.it website, applicable to the contractual relationship between RAM Apparecchi Medicali Srl and the customer.
“RAM Apparecchi Medicali Srl” or “Supplier” is the company that owns the website medicalistore.it which sells its products in Italy and in the countries of the European Community. The conditions of sale, shipping methods and the right of withdrawal may vary depending on the country of destination. The company is based in Genoa, Via G. Casaregis 19/25R.
“Products”: are all the products and/or goods and/or services marketed by RAM Apparecchi Medicali Srl and part of its assortment.
“Customer”: is the purchaser of the Products and Services, meaning both natural persons (consumers) who purchase for personal use and legal persons or healthcare professionals who purchase for work purposes (B2B).
“Site”: the set of web pages that can be consulted on the Internet at the address, medicalistore.it
2. Object of the online contract
By "online" sales contract we mean the distance contract, i.e. the legal transaction having as its object the products and services offered on the site, stipulated between RAM Apparecchi Medicali srl and the customer within a remote sales system organised by the supplier via its own website.
3. Contract formalization
All contracts are concluded directly through the customer's access to the medicalistore.it website where, following the indicated procedures, he is supported step by step in the conclusion of the contract for the purchase of the product or service.
Orders can also be sent by FAX (to the number 010.580683) by filling out the appropriate form (fax form), or by e-mail (info@medicalistore.it), specifying the billing and shipping data of the goods, the VAT number or tax code and the preferred payment method.
All purchase orders transmitted to RAM Apparecchi Medicali srl must be completed in all parts and must contain the elements necessary for the exact identification of the Products or services ordered, of the Customer and of the place of delivery of the goods.
The purchase order transmitted to RAM Apparecchi Medicali srl is valid as a contractual proposal of the Customer expressed online.
Order confirmation by RAM Apparecchi Medicali srl, sent to the Customer at the email address indicated by the latter, confirms the order data and is valid as acceptance of the contractual proposal.
RAM Apparecchi Medicali reserves the right, at its sole discretion, not to accept incomplete or incorrectly filled out orders.
4. Delivery times and methods of products
RAM Apparecchi Medicali will deliver the Products, selected and ordered in the manner described in the previous article, to the Customer by means of trusted couriers and/or forwarders, or personally with its own representatives.
The expected delivery times are indicated on the site under the price of the product. The expected delivery times for orders consisting of multiple products will be equal to the longest delivery time among those of the products inserted in the cart. The indicated term is to be understood as indicative and not peremptory. The Seller therefore reserves the right to deliver the Products within 30 days of sending the order. In the event of products damaged during transport, the Customer is required to report the anomaly within 48 hours of delivery, attaching photos of the damage and the packaging, to allow the opening of a complaint with the courier. The Seller recommends that you check the number of Products received and that the packaging is intact, not damaged, not wet or in any way altered, including the sealing materials and you are invited, in your interest, to indicate any anomalies on the carrier's transport document, accepting the package with reservation. In the event that the packaging shows obvious signs of tampering or alteration, it is advisable to promptly notify the Seller.
With reference to the possibility of requesting delivery of the Products to a “collection point”, the Seller informs you that you have the possibility of collecting the Product from a collection point, based on the options and methods available on the Site and/or during the purchase process, provided that this method is available for the Product selected by you. You will be promptly notified when the Product is ready to be collected from the collection point chosen by you. Unless otherwise agreed, if you do not fulfill the obligation to collect the Product, the purchase contract will be considered terminated by law. As a result of the termination, the order will be cancelled and the Seller will proceed to refund the Total Amount Due paid by you.
The delivery of the Products is subject to payment by the Customer of the relevant price using the means chosen from those made available by RAM Apparecchi Medicali Ltd.
The tax documentation (invoice) is issued by RAM Apparecchi Medicali srl based on the data provided by the customer when completing the order.
5. Prices
All sales prices of the Products indicated on the Site are expressed in Euros.
Unless otherwise indicated, Product prices include VAT and any other taxes.
The prices of individual Products, indicated from time to time on the Site, cancel and replace the previous ones. RAM Apparecchi Medicali srl reserves the right to change sales prices without notice. We will not be liable for any errors in the prices on our site.
The prices applied are those indicated on the Site at the time of the purchase order by the Customer.
6. Product Availability
The Products offered on the Site are limited in number. It may therefore happen, also due to the possibility that multiple users purchase the same Product at the same time, that the ordered Product is no longer available after the transmission of the purchase order.
Information on the expected delivery times of the Products is available on the Site.
You will be informed in case of unavailability of the ordered Product. In this case, you will be entitled to terminate the purchase contract.
If a refund is requested for the purchase of Products that subsequently become unavailable, the Seller will make the refund within 1 working day.
In the event that you exercise the right of termination, the contract is terminated. In the event that the payment of the total amount due, consisting of the price of the Product, shipping costs, if applicable, and any other additional costs, as resulting from the order (Total Amount Due) has already occurred, the Seller will refund the Total Amount Due.
7. Responsibility of RAM Apparecchi Medicali Ltd.
RAM Apparecchi Medicali srl is not responsible for any disruptions attributable to force majeure of any nature and kind, in the event that it is unable to execute the requested supply within the agreed and foreseen times of this contract. Causes of force majeure include, by way of example and not limited to, measures by the Public Authority, strikes by its own employees, employees of third-party companies or employees of the carriers of which RAM Apparecchi Medicali srl makes use of, as well as any other circumstance that is beyond the control of or dependent on the latter.
8. Customer Obligations
The Customer undertakes, once the online purchase procedure has been completed, to print and keep these General Conditions.
The information contained in the General Conditions must be viewed and accepted by the Customer before sending the purchase order, in order to fully satisfy the conditions of the Consumer Code (D.Lgs. 206/2005, amended with D.Lgs. 21/2014). Acceptance occurs by marking the appropriate space on the site. In the absence of this, the order cannot be executed.
9. Right of withdrawal
Sales of products via the Internet are governed by the Consumer Code – D.lgs.206/2005 amended by Legislative Decree 21/2014 in implementation of Directive 2011/83/EU – which regulates the matter of distance contracts, i.e. contracts carried out outside of commercial premises. This legislation establishes the right of withdrawal, i.e. the possibility for the consumer to return the purchased product and obtain reimbursement of the expense incurred.
There are, however, some exceptions: for some types of goods and services it is not possible to withdraw, for example if they are leisure contracts, custom-made goods or sealed goods.
RAM MEDICAL DEVICES s.r.l. guarantees the right to withdraw, for any reason, from the purchase contract. This right is reserved exclusively for natural persons (consumers), therefore it cannot be exercised by legal persons and natural persons acting for purposes related to any professional activity they may carry out.
To exercise the right of withdrawal, it is necessary to send (without indicating the reasons), within 14 days of receiving the goods, a communication via email to info@medicalistore.it or via registered mail in which the intention to withdraw from the contract is expressed.
All payments made to us will be refunded, including delivery costs (with the exception of optional costs such as telephone appointments and delivery to the floor), without undue delay and in any case no later than 14 days from the day of communication of withdrawal from the contract and exclusively once the goods have been returned to the sender having passed the integrity check. These refunds will be made using the same means of payment used for the initial transaction, unless otherwise expressly agreed; in any case, no costs will be charged as a consequence of such refund.
The right of withdrawal does not apply to audiovisual software products and sealed computer software opened by the consumer.
RAM MEDICAL DEVICES s.r.l., according to the Consumer Code (D.Lgs. 206/2005, amended with D.Lgs. 21/2014), informs that the only costs requested from the customer are those for returning the product.
The right of withdrawal lapses entirely if the returned product is not intact and unused, or:
- missing original packaging
- absence of integral elements of the product (accessories, cables, instruction manuals, etc.)
- damage to the product due to causes other than transport.
Unless otherwise indicated on the packaging, materials subject to wear and tear due to use or exhaustion are always excluded from the Warranty, and more specifically: rechargeable and non-rechargeable batteries, cuffs for sphygmomanometers and other equipment, aerosol ampoules, air tubes, cables, inner tubes, wheelchair tires, and in any case any component that is subject to natural wear and tear due to use.
The following products cannot be returned at any time:
- All types of software with damaged packaging/packaging;
- All types of products related to personal care, health and hygiene, specifically in the case of sealed goods that are not suitable for return for hygiene reasons, or related to health protection, and are opened after delivery (e.g. creams, cosmetic products, toothpastes, food supplements and other similar goods), as well as medical devices pursuant to art. 47, paragraph I, letter b of the Consumer Code.
- All types of products that require professional installation and have been installed after purchase (hoods, surgical lamps, etc.).
If the returned product does not meet the required conditions (e.g. without original packaging, damaged, or missing parts), the refund may be reduced or refused. In this case, the Customer may request the return of the product at his/her own expense.
10. Procedure for exercising the right of withdrawal
If you have made a purchase on our site and you wish to withdraw from the purchase, you must follow this simple procedure:
- Send to RAM Apparecchi Medicali within 14 days of receiving the goods, a communication by email to info@medicalistore.it, by fax to 010/580683 or by post using this form.
- Within the working day following your communication, you will receive notification of the authorization to return the goods.
- Please arrange for the shipment of the product within 14 days, carefully packaged in its original packaging and complete with all accessories, instruction manuals and everything originally contained, using a courier of your choice and with shipping costs at your expense. Please note that under no circumstances will shipments be accepted at our expense. Only items shipped within the terms, in perfect condition and in their original packaging will be subject to a refund. The goods must be accompanied by the Return Form filled out in its entirety or by another type of documentation that allows us to identify the sender and that it is a request for reimbursement for withdrawal from the order.
- RAM Apparecchi Medicali s.r.l. will refund all payments made, including delivery costs (with the exception of optional costs such as telephone appointments and floor delivery), without undue delay and in any case no later than 14 days from the day of notification of withdrawal from the contract. The refund may be suspended until the goods are received. Such refunds will be made using the same means of payment used for the initial transaction, unless expressly agreed otherwise; in any case, no costs will be charged as a consequence of such refund.

ATTENTION: it is recommended to use a courier or other suitable means for shipping to allow tracking of the shipment. It is understood that RAM will not refund the goods subject to withdrawal if it does not receive the relevant delivery. Insure the shipment against theft and damage during transport and bear the related costs. If the returned product has not been insured for the value indicated on the invoice, in the event of damage or loss during transport, RAM APPARECCHI MEDICALI s.r.l. reserves the right to charge any damages incurred by withholding them from the sums to be refunded.
RAM MEDICAL DEVICES s.r.l. will proceed with the refund within 14 working days following the request for withdrawal and in any case not before receiving the goods.
Please note: for purchases made by choosing CONSEL installment payment as the payment method, the refund will not be made by bank transfer, but rather by requesting Consel to reverse the transaction made.
11. Payment Methods
Payments made by credit card or other electronic means are made via a secure connection, directly linked to the Banking Institution that owns and manages the “online” payment service with which RAM Apparecchi Medicali srl is affiliated. RAM Apparecchi Medicali srl does not come into possession of the customer's credit card data and cannot be held responsible for any fraudulent use of the card in question.
- Scalapay: Choose Scalapay at checkout. Receive your order immediately and pay in 3 convenient installments of the same amount, without interest, due every 4 weeks. You can use Scalapay for purchases up to a maximum of 300 euros.
- Credit card: using our online shopping you can pay with VISA, VISA Electron, PostePay, Mastercard, Carta Aura, American Express and Diners.
- PayPal: Using PayPal is really simple. Open a free account, confirm your email and associate a payment method with your PayPal account. With PayPal you do not have to enter your financial information for each purchase, nor share your personal data with the seller.

12. Changes to these conditions
RAM Apparecchi Medicali srl reserves the right to modify the rules that govern these General Conditions as well as the economic conditions applied to the same. Any changes that are unfavorable to the Customer will be communicated to the Customer by email to the last address indicated by the latter. In the event of changes that are unfavorable to the Customer, the latter may, within 15 days of receiving the relevant communication, withdraw from the contract. Otherwise, the changes will be considered accepted
13. Disputes and applicable law
Any dispute relating to the application, execution, interpretation and violation of the contract stipulated online by the Customer with RAM Apparecchi Medicali srl is subject to Italian jurisdiction.
For anything not expressly provided for herein, the legal provisions applicable to the relationships and situations envisaged in the contract stipulated online by the Customer with RAM Apparecchi Medicali Ltd.
For sales to professionals and companies, the competent Court is Genoa. For sales to private consumers, the competent Court will be that of the consumer's residence.
Pursuant to Articles 1341 and 1342 c.c., the Customer declares to have carefully read the General Conditions reported above in all their points and after careful rereading to expressly accept all the points.
RAM Apparecchi Medicali Srl reserves the right to refuse, suspend or cancel an order, even after confirmation, in the following cases:
Product unavailability: if, due to error or delays in updating the warehouse, the product is no longer available.
Obvious errors in pricing or descriptions: If an obvious error is found in the price or description of the product (e.g. a price significantly lower than the market value due to an entry error).
Fraud or suspicious activity: If there is suspicion of fraud in the order or if the customer has provided incomplete or inaccurate information.
Customers with a history of failed collection or refused receipt: to ensure efficient management, RAM Apparecchi Medicali reserves the right not to accept orders with cash on delivery payment methods from customers who have refused previous shipments without justification.
Force majeure events: strikes, service interruptions, supply problems or events beyond the control of RAM Apparecchi Medicali which prevent the order from being processed within the expected timeframes.
In case of cancellation of the order for one of the reasons indicated above, the customer will be promptly informed and refunded without any penalty.
14. Suspension of service
Suspension of service for maintenance or updates:
RAM Apparecchi Medicali Srl reserves the right to temporarily suspend the medicalistore.it website or some of its features for technical needs, maintenance or updates.
- Suspension may occur without notice in the event of urgent interventions.
- In case of scheduled maintenance, the customer will be informed at least 24 hours in advance via notices on the site or e-mail.
- During the suspension, you will not be able to make purchases, view orders, or access online customer service.
Suspension of service due to force majeure:
RAM Apparecchi Medicali Srl will not be liable for delays or failure to execute orders due to force majeure, including, but not limited to:
- Natural events (earthquakes, floods, fires).
- Strikes and protests that block transportation or supplies.
- Disruptions to payment services or telecommunications networks.
- Wars, pandemics or terrorist acts.
- Sudden customs blockades or regulatory restrictions.
- Delays or problems caused by couriers or suppliers.
- Unavailability of products due to unforeseeable events.
In such cases:
- The customer will be notified as soon as possible.
- Orders already placed may be delayed. If the delay exceeds 30 days, the customer will be entitled to cancel the order and receive a full refund without penalties.
- RAM Apparecchi Medicali Srl will not be liable for any indirect damages resulting from the suspension of the service.
In no case RAM Apparecchi Medicali Srl may be held liable for any indirect damages, loss of profits or any other consequence arising from the suspension or cancellation of an order.
If an order cannot be processed due to suspension of service for technical reasons or force majeure, the customer may:
- Request a full refund of the amount paid.
- Please wait for service to be restored, if possible, with a new estimated delivery date.
Any suspension of service will not give right to claims for compensation or damages, except for the refund of any orders paid and not fulfilled. The customer accepts that the refund of the amount paid for a canceled order represents the only remedy available in such cases.
15. Shipments
Shipping costs are calculated in the cart when adding products and depend on the destination country.
Normally the order is taken in charge on the same day of insertion and prepared for shipments the next working day. In case of delay you will be promptly contacted for updates on the status of the order. The shipping times of the individual products are indicated under the price.
Order processing is immediate for payments by credit card and cash on delivery
For payments via Advance Bank Transfer, the goods will be shipped as soon as notification of payment has been received from the bank.
RAM Apparecchi Medicali will not be responsible for any delays or failure to deliver resulting from logistical problems, unavailability of stock or other causes beyond its control.
16. Guarantee for Private Consumers (B2C)
The products sold on medicalistore.it to private customers are covered by the Legal Guarantee of Conformity pursuant to articles 128-135 of the Consumer Code (D.Lgs. 206/2005).
The warranty lasts 24 months from the date of delivery and covers defects of conformity already existing at the time of purchase.
In case of a defective product, the customer has the right:
- To the free repair or replacement of the product (at the seller's discretion, except in cases of impossibility or excessive costs).
- If repair or replacement is not possible, a price reduction or refund.
- The consumer must report the defect within 2 months of discovery.
The following are excluded from the warranty:
- Damage resulting from improper use or maintenance not in accordance with the instructions.
- Consumables or materials subject to natural wear and tear (e.g. batteries, blood pressure cuffs, disposable sensors, etc.).
- Damage caused by repairs carried out by unauthorized personnel.
Warranty Service Procedure:
- The customer must contact customer service via email at tecnica@medicalistore.it or by telephone.
- If the defect is confirmed, you will be provided with an RMA (Return Merchandise Authorization) number and shipping instructions.
- The product must be returned with the original packaging and all accessories.
The warranty does NOT cover materials subject to natural wear, such as:
- Rechargeable and non-rechargeable batteries.
- Sphygmomanometer cuffs and medical equipment.
- Aerosol ampoules, air tubes, cables and disposable sensors.
- Wheelchair tires, inner tubes.
The warranty also does NOT cover:
- damage from improper use or tampering.
- products with removed or altered security seals.
- software and electronic devices if opened and used.
17. Guarantee for Professionals and Companies (B2B)
If the purchase is made with a VAT number (company, medical practice, healthcare professional), the Commercial Guarantee provided for by the Civil Code (art. 1490 et seq.) applies.
For purchases with VAT number (companies and professionals), the commercial guarantee lasts 12 months from delivery of the product.
Any defects must be reported within 8 days of discovery, as provided for by the Civil Code (art. 1490 et seq.).
RAM Apparecchi Medicali may, at its discretion, repair the product, replace it, or issue a credit note.
The cost of shipping for repair may be borne by the customer based on the warranty conditions provided by the manufacturer.
The warranty does NOT cover materials subject to natural wear, such as:
- Rechargeable and non-rechargeable batteries.
- Sphygmomanometer cuffs and medical equipment.
- Aerosol ampoules, air tubes, cables and disposable sensors.
- Wheelchair tires, inner tubes.
The warranty also does NOT cover:
- damage from improper use or tampering.
- products with removed or altered security seals.
- software and electronic devices if opened and used.
18. Repairs
Repairs and InterventionsDelivery and collection of repaired or unrepaired products to be carried out at the laboratory RAM Apparecchi Medicali Srl located in Via Casaregis, 19/25r is at the customer's care, expense and risk.
In case the transport was carried out by RAM Apparecchi Medicali Srl directly or by courier, the products travel under the responsibility of the customer, therefore RAM Apparecchi Medicali Srl declines all responsibility for theft, damage and any other event. Upon specific request of the customer RAM Apparecchi Medicali Srl evaluates the possibility of insuring the transport by charging the relative cost in addition to the transport price.
The customer is obliged to collect the goods within and no later than 30 days from the notification of goods ready beyond this deadline RAM Apparecchi Medicali Srl has the right to avail itself of Article 2756 of the Civil Code which grants creditors for services and expenses relating to the conservation and improvement of movable property, a privilege on the goods provided that they are still in the possession of the person who performed the service and/or incurred the expenses. Therefore, in the event of failure to collect and pay for the repair RAM Apparecchi Medicali Srl, in addition to not being required to return the asset, also has the right to "sell it according to the rules established for the sale of the pledge" (art. 2797)
